IT Dispute Prevention and Recovery

IT Dispute Prevention

Experience shows that many IT disputes arise due to a lack of shared expectations, commitments, plans or contract management processes. In many cases, when legal contracts are signed, the supporting documentation needed for both parties to meet their obligations is either incomplete, disconnected from day-to-day management processes or quickly becomes out-of-date.

To meet these needs, we provide a contract concierge service to proactively prevent disputes occurring through providing clear and supportive information on mutual obligations and key contractual terms, linked to real-world development activities and challenges.

A key element of this service is achieving requirements traceability as significant business requirements are often not embedded in relevant documentation – likewise, key contractual terms and milestones are often not included in project governance and management methodology and obligations.

By providing an effective dynamic link between contract terms and schedules and the project management documents and frameworks needed to demonstrate mutual obligations are being met, the risk of IT disputes arising is minimised.

IT Dispute Recovery

We provide help with resolving technology disputes through the provision of investigative consulting resources, programme management input, work-around design and delivery services. We also provide independent benchmarks of service and IT performance.

As part of programme turnaround, we work with you to mediate an opportunity to re-plan while ensuring your contract position is protected and establish appropriate on-going contract terms and SLAs.

We go beyond the normal PMO and governance review by providing technical audit and sign-off services to verify the completeness and quality of deliverables at key milestones.

We can help oversee the delivery of remedial work for insurers as part of an agreed claims handling process. We can also provide independent experts to support litigation as advisors or expert witnesses and mediation support.

Post recovery, we can work with you to put in place ongoing governance and contract management and monitoring arrangements, through our contract concierge service.

Kemp Little and Kemp Little Consulting are uniquely placed to help you meet these challenges.
